LOCATION OF POSITION: Elkhart County Judicial Center, Goshen, Indiana
Job Summary
Responsible for acting as the appointed juvenile magistrate for the family division. This position would preside over the following case types: Juvenile Paternity, Domestic Relations, Reciprocal Support, Adoptions, Guardianships, Protection Orders, Grandparent Visitation, Miscellaneous Civil, and at times, Juvenile CHINS, Juvenile Delinquency, Juvenile Status, Juvenile Miscellaneous, Juvenile Termination, and Juvenile Protection. Additionally, this position may conduct evidentiary hearings or bench trials.
Take and certify affidavits or depositions, order issuance of subpoenas, compel attendance of witnesses, punish contempt of court, issue warrants, set bail, and enforce court rules.
Report findings in evidentiary hearings or trials. Verify certificates for the authentication of records of a proceeding conducted by the magistrate.
Review memoranda and files in regard to hearings, discussions with judges, probation officers, attorneys, and/or caseworkers as needed.
Perform other duties as allowed by law, including, but not limited to, administering an oath or affirmation.
Serve as a judge pro tempore or as a special judge as required.
Serves a 7-day, 24-hour on-call status in rotation with all other elected judges and magistrates for emergencies.
Supervises and manages assigned court staff.
Performs related duties as assigned.
Job Requirements
- Possession of a Doctor of Jurisprudence degree and admission to practice of law in the State of Indiana.
- Thorough knowledge of Indiana Supreme/Appellate Court decisions, Indiana Rules of Trial Procedure, and Indiana Rules of Evidence.
- Thorough knowledge of standard practices and procedures of the court, legal terminology, standard legal documents and petitions, and Indiana Code.
- Ability to read/interpret detailed Indiana Supreme/Appellate Court decisions, Indiana Code, legal websites, Family and Juvenile Court Journal, and delinquency bench books.
- Ability to supervise assigned staff, including interviewing and making hiring decisions, orienting new subordinates, establishing specific work goals, and keeping supervisor and assigned staff informed of organization developments.
